Terms and Conditions

1.0 When Requesting a Quote and Expecting an Invoice

 

1.1 Our provided quotes are applicable solely to the structural elements listed. Any additional design requirements are not included in the original fee unless otherwise agreed.

 

1.2 The only exception to the previous provision is for addressing comments from building control concerning existing conditions present at the time of the most recent issue of drawings from the appointed architect before the quote's production.

 

1.3 The initial quote may be subject to adjustments following a site visit if deemed necessary.

 

1.4 If a site visit occurs, only the initial findings from a visual inspection and clearly visible elements at that time are considered in the quote or any subsequent revisions.

 

1.5 If a revision is needed after a site visit and the client opts not to proceed, the associated site visit fee remains payable. If the fee isn't itemized in the quote, it can be confirmed upon request.

 

1.6 Any included site visit in the quote is limited to the first one unless stated otherwise. Additional site visits are not covered by the original fee.

 

1.7 Any need for additional design due to future revisions of architect drawings or other external sources' information must be promptly communicated to us. Such revisions are not part of the original fee unless otherwise specified.

 

1.8 Our firm does not hold responsibility for third-party designs or any deviations unless agreed upon otherwise.

 

1.9 Calculations in the quote will be presented in a structural design package in PDF format, excluding structural drawings unless explicitly mentioned.

 

1.10 Upon acceptance of the quote, the client will be notified when the calculation package is ready, and an invoice will be issued. Payment is required within 7 days before releasing the calculation package.

 

2.0 Suspension of Works

 

2.1 If a project on which we are engaged halts for six months or longer, all existing agreements are voided. Terms, including information delivery, fee structure, and ongoing work, must be renegotiated.

 

2.2 If renegotiation fails, we have no further obligation or proprietary rights over future works on the project.

 

3.0 When Requesting the Instruction to Undertake Design to be Voided

 

3.1 If the client requests to void the instruction to undertake work, all work produced up to that point and associated costs will be invoiced. The amount invoiced is at our discretion but can be validated upon request.

 

3.2 If delivery dates are not met, and works are finalized before the client's request to void the instruction, invoices must be settled within 2 working days of the voiding request.

 

3.3 Advance fees for structural design packages are non-refundable unless otherwise agreed upon.

 

4.0 Disputes

 

4.1 We address queries initiated by parties contractually bound to the works. Unsolicited third-party advice may be considered at our discretion.

 

4.2 Joint ventures or partnerships for design provision must be agreed upon before design instruction. This includes design checks beyond the appointed building control body.

 

4.3 All instructed works are subject to a non-disclosure agreement, including but not exclusive to online platforms and review sites.

 

4.4 Negative comments or online reviews perceived as attempts to leverage or defame us may result in up to £10,000 in damages.

 

4.5 Time spent on unsuccessful dispute resolutions will be billed at £50 per hour, rounded up to one unit at our discretion.
